Waqf Pack — Terms of Use, Licence & Copyright

WARNING: Unauthorised reproduction or distribution of the Waqf Pack is strictly prohibited. The Materials are licensed to a single organisation only. Breach may result in legal action under the Copyright, Designs and Patents Act 1988.
1.

Ownership of Materials

All documents, templates, frameworks, and associated materials comprising the Waqf Pack (the “Materials”) are the exclusive intellectual property of National Waqf Ltd (the “Provider”), unless otherwise stated.

The Materials are protected under the Copyright, Designs and Patents Act 1988 and applicable international intellectual property laws.

2.

Licence Grant (Limited, Non-Transferable)

Upon approval and payment (or waiver), the Provider grants the purchasing organisation (the “Licensee”) a limited, non-exclusive, non-transferable, non-sublicensable licence to use the Materials solely for its own internal purposes in establishing and managing its own Waqf.

This licence is granted to the organisation only, not to any individual.

3.

Strict Prohibition on Sharing or Distribution

The Licensee must not, without prior written consent from National Waqf:

  • Share, distribute, circulate, or make the Materials available to any third party;
  • Provide the Materials to other charities, organisations, advisors, or consultants for their use;
  • Upload or store the Materials on publicly accessible platforms or shared drives accessible outside the organisation;
  • Reproduce, modify, adapt, or create derivative works for external use;
  • Use the Materials to provide advisory, consultancy, or commercial services to others.

Access is strictly limited to internal use by authorised representatives of the Licensee organisation.

4.

Permitted Internal Use

The Licensee may:

  • Use the Materials internally for trustee discussions, governance, and implementation;
  • Share internally with trustees, senior management, and employees strictly on a need-to-know basis;
  • Adapt the Materials for its own internal Waqf structure (provided such adaptations are not distributed externally).
5.

Security and Responsibility

The Licensee is responsible for:

  • Maintaining the confidentiality of the Materials;
  • Ensuring that access is restricted within the organisation;
  • Preventing unauthorised copying, sharing, or distribution.

Each copy of the Materials may be individually marked, watermarked, or password-protected.

6.

Breach and Enforcement

Unauthorised use, reproduction, or distribution of the Materials constitutes a breach of these Terms and may also amount to copyright infringement under UK law.

National Waqf reserves the right to:

  • Immediately terminate access to the Materials;
  • Pursue civil remedies including injunctive relief and damages;
  • Recover any losses arising from misuse;
  • Take any further action permitted under law.
7.

No Assignment or Transfer

The licence granted is specific to the approved organisation and may not be:

  • Assigned, transferred, or sublicensed;
  • Used by any affiliated or connected entity without express written consent.
8.

Disclaimer

The Materials are provided as a guidance framework to support the establishment of a Waqf.

They do not constitute formal legal, tax, or financial advice, and the Licensee remains responsible for obtaining independent professional advice where required.

9.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
